Terms and Conditions for International Mountain Connection

General Terms and Conditions for Professional Training

The following are the general terms and conditions of sale for the training organization International Mountain Connection regarding the training services provided in the framework of continued professional training provided either in Modane, France, online, or elsewhere in the country.

Michelle Onofrey EI – SIRET N° 880 252 655 00019 – International Mountain Connection is located at 320 rue Pré Soleil, 73500 Modane, France and registered under N° 84730241073. This registration is not equivalent to government accreditation (Art. L.6352-12 of the Labor Code).

These General Conditions of Sale lay out the conditions that are applied to the services carried out by International Mountain Connection for their client. All training that is purchased implies that the client has accepted these General Conditions of Sale. These conditions overrule any other document or contract of the client, particularly any general conditions of purchase. International Mountain Connection can modify these terms and conditions at any time. The applicable GTC are those which were given and accepted by the client.

Quotes

Quotes are sent to potential clients after a consultation with an International Mountain Connection representative to access the type of program that is necessary to achieve their goals. All quotes are free of charge and do not bind the client to participate in training with International Mountain Connection. The prices of quotes are valid for 6 months from the date of the quotation.

Contract

If the client agrees to the program and price proposed in the quote, IMC sends an official convention (B2B) or contract (B2C) which is sent back by the client, signed, stamped and dated by the client with the mention “approved”. Two copies of the signed convention or contract are created, one for the client and one for International Mountain Connection.

Before sessions start, each trainee for the contract completes a language evaluation and an additional consultation with their training to define their training program.

Seven days before the start of a training course, the client and/or trainee receives a convocation for the training. The client and/or trainee will also receive a welcome booklet with a copy of their program and the training rules and regulations for the training sessions. Clients and/or trainees must familiarize themselves with these rules before their first training course. Their signature on the sign-in sheet indicates that they have read and understood these rules, as well as the use of their personal data for administrative tasks related to their training.

Price

The price of the training program is clearly stated in the quote and signed convention or contract. This price is without tax as Michelle Onofrey EI – International Mountain Connection is not able to charge tax due to article 293 B of the CGI. of the French Tax Code.

Billing and payments

B2B

B2B payments are due by the client before the first day of training.

Late payment

Any delay in payment will result in the payment of late payment penalties at a rate equal to 2.61% and a minimum fixed indemnity of 40 (forty) euros for collection costs, due ipso jure, without the need for a reminder.

B2C

For B2C, the trainee makes an initial payment of no more than 30% of the price due. The payment of the balance, at the trainee’s expense, is spread out over the course of the training program, according to the schedule set out in their contract.

Payments can be made by wire transfer.

Financing

If the traininee’s course is funded by their Organisme Paritaire Collecteur Agréé (OPCA), the client must provide proof of funding prior to the start of the course. Full payment for the programme is due before the start of the course. At the end of the course, the trainee will receive a receipt and a course completion certificate to provide to their OPCA for reimbursement.

If the training is financed by the trainee’s CPF account, the amount is deducted from his or her account when he or she registers for training on the platform. If the cost of the training exceeds the amount in the account, the trainee is required to pay the difference before starting the training.

Making appointments for individual training sessions

A link is provided to trainees to make appointments for their individual training sessions. These appointments must be booked for the amount of session time stated in the trainee’s contract. For example, if the sessions are 30 minutes long, appointments must be booked for 30 minutes.

Please allow 48 hours between the time the appointment is booked and the time of the next appointment so that the trainer has ample time to prepare for the next session.

Training cancellation and rescheduling

B2B 

If a training course is only partially carried out, whether through the fault of the customer or the training organization, the customer will only be invoiced for the services provided, and will receive a refund for the training course not carried out.

A course cancelled by a client

All cancellations must be sent by e-mail to michelle.onofrey@internationalmountainconnection.com.

If a course mentioned in the signed contract is cancelled at least 15 full days before the scheduled start date, the customer will be reimbursed 100% of the total cost of the course.

In the event of cancellation 8 to 14 days before the course date, the customer will be charged a cancellation fee corresponding to 50% of the total cost of the course.

In the event of cancellation 3 to 7 days prior to the course date, the customer will be charged a cancellation fee equivalent to 75% of the total cost of the course.

In the event of cancellation 48 hours or less before the training date, the customer will be charged a cancellation fee equivalent to 100% of the total cost of the training.

Training sessions

All cancellations must be sent by e-mail to: michelle.onofrey@internationalmountainconnection.com or via the link at the bottom of the page in the confirmation e-mail for that session.

With regard to the cancellation of one or more training sessions within a training course, the following conditions apply:

In the event of cancellation 8 to 14 days before the date of the training session, the customer will be charged a cancellation fee equivalent to 50% of the total cost of the session.

For cancellations 3 to 7 days prior to the date of the training session, the customer will be charged a cancellation fee equivalent to 75% of the total cost of the session.

In the event of cancellation 48 hours or less before the date of the training session, the customer will be charged a cancellation fee equivalent to 100% of the total cost of the session.

Cancellation of one or more training sessions by one or more trainees

In the event of cancellation of one or more sessions by one or more trainees (except in the case of total cancellation of sessions or total cancellation of participation), the customer is subject to the following cancellation fees:

Cancellations 8-14 days before the date of the training session, the customer will be charged a cancellation fee equal to 50% of the total cost per trainee and per session.

For cancellations 3-7 days prior to the training session date, the customer will be charged a cancellation fee equal to 75% of the total cost per trainee and per session.

In the event of cancellation 48 hours or less before the date of the training session, the customer will be charged a cancellation fee equivalent to 100% of the total cost per trainee and per session.

B2C 

In the event of cancellation by the trainee less than 48 clear hours before the start of a session, the trainee will be invoiced for the session. If the trainee cancels more than 2 sessions per month for two months, the Training Organization reserves the right to cancel this contract and refuse to continue the training.

For trainees funded by their CPF or other means of financing, any cancellation made less than 48 hours in advance will be invoiced. Trainees are encouraged to refer to UGC au titualaires for the consequences of not completing their program as planned.

Cancellations by International Mountain Connection

In the event of cancellation by International Mountain Connection, the customer will be informed as soon as possible and the course will be rescheduled.

In the event of force majeure (as defined by French jurisprudence), which prevents the training organization from providing all or part of the training program, the organization undertakes to seek any solution which, under reasonable conditions of cost and operating constraints, will enable it to continue the normal performance of the services covered by the present contract.

Rescheduling of training programs and training sessions

Rescheduling of training programs 10 business days prior to the training date.

Rescheduling of training sessions should be made 48 hours in advance, when possible.

Training course program

International Mountain Connection may modify the contents of the training to correspond to the group dynamics and level of the participants.

Equipment

The trainee confirms that he/she has access to a computer equipped with a webcam and microphone, and that he/she has high-speed Internet access, if he/she chooses to conduct remote sessions.

Training materials

All training materials, including digital, paper, electronic, etc, are protected by intellectual property and copyright. Without the express permission of International Mountain Connection, these materials can not be reproduced, partially or totally. The client, therefore, agrees not to transmit or reproduce the materials that were provided for the training, including password and login information for the e-learning platform.

Personal data and freedom of information

The personal information that is communicated by the client to International Mountain Connection is used to register the client, create their contract and to propose future services. According to the law, « informatique et libertés » du 6 janvier 1978, the client has the right to access, correct or demand the deletion of their personal information.

Each customer is required to fill in a form concerning the processing of personal information for training purposes.

Litigation – Mediation for Consumers

In the event of a dispute between the Customer and the company, they shall endeavour to resolve it amicably (the Customer shall send a written complaint to the professional or, where appropriate, to the professional’s Customer Relations Department).

In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Customer within the terms of Article L.133-4 of the French Consumer Code has the possibility of referring the matter free of charge, if a disagreement remains, to the competent mediator (in French) registered on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation pursuant to Article L.615-1 of the French Consumer Code, namely:

The following are the general terms and conditions of sale for International Mountain Connection regarding the translation services provided at 320 rue Pré Soleil in Modane, France.

All translations that are purchased implies that the client has accepted these General Conditions of Sale. Quotes for translations

The following THREE pieces of information must be included to receive a free quote from International Mountain Connection:

Once these three elements have been transmitted to International Mountain Connection, a quote can be sent to the potential client. 

If the quote is accepted, the client must send a signed copy of the quote and the Notifications Contract to International Mountain Connection before the translation work begins.

It is important to note that translation projects will not start until an agreement has been made regarding the price and deadline for the translation project AND a Notifications Contract has been signed.

Notifications Contract Information

A Notifications Contract has two main functions:

  1. It allows you to declare the representative from the client’s organization who is responsible for answering questions regarding the text of the translation project. The client must provide an email address and phone number where they can be reached.
  2. The client decides how and when they wish to be notified if changes are made to the project that will require additional charges.

Organization Representative Contact Information

It is important to provide contact information for a representative from the client’s organization that can be contacted directly if there is a question or concern regarding the content of the text to be translated.

In the event that a representative can not be reached during a project, delays can occur in the translation process. Please make sure that IMC has a telephone number and email address for this contact.

IMC is not responsible for delays in a translation project if the designated contact person from the client’s organization is not available or does not respond to requests for clarification of information.

Notifications when additional charges are incurred on a project

Sometimes clients realize in the middle of a translation project that modifications need to be made to the text they originally sent, or content must be added. Additionally, sometimes deadlines need to be moved up from the date that was given during the quote.

As a result of these types of incidents, additional charges will be incurred due to the additional amount of work that must be done to complete the project. 

In the Notifications Contract, clients can decide how and when they will be contacted in case of additional charges so that they don’t have any surprises when they are billed at the end of their project.

The process when changes are made to the project

Change of delivery date

Quotes correspond to the original date given to complete and deliver the translation project. 

In the event that the date must be moved up by the client, additional costs will be incurred. 

In the event that the date needs to be extended due to the client modifying or adding text to the original project, no new charges will be incurred due to the extension of the date, but new charges will be incurred due to the additional text that must be translated.

It is important to understand that International Mountain Connection accepts projects based on availability. We will not accept a translation project if it is not possible to deliver a quality translation by the date requested. 

This is why it is important to notify IMC as soon as possible if a deadline needs to be changed for the delivery of a translation project. We need to verify that we are still able to honor the contract by the new deadline.

In the event that IMC is unable to complete the translation by the new delivery date, the client will be responsible for paying for the text that has already been translated up to the date the request was made, in addition to a €50 administrative fee.

Adding / Changing text during a current translation project

The price indicated on the quote is for the text that was furnished for the quote. The quote does not include additional work that is added or changed by the client during the project. 

Additional charges will be incurred for additional time spent on the project. The client will be notified of these charges as outlined in the Notifications Contract that was signed between the client and IMC.

Quotes for Proofreading / Editing

If a project requires proofreading or editing text that was already published in English, International Mountain Connection can provide a free quote for these services.

In order to create a quote for the project, it is necessary to send the following information:

Please note that this service is available for text that has been written in English, this is not a service to be requested after a translation was completed within the client’s organization using an automatic translation service for IMC to correct. 

Any text that is reviewed that is incomprehensible in English will be charged as a translation and the original text in French will be requested.

Price

The price of the translation is clearly stated in the quote that is signed by the client. Any changes in the price due to text being added or modified by the client or due to the change of a delivery date conform to the Notifications Contract signed by the client when accepting the quote.

This price is without tax as Michelle Onofrey EI – International Mountain Connection is not able to charge tax due to article 293 B du CGI.

Billing and Payment

Payments are due upon receipt of the invoice. 

Late Payments

Confidentiality
